Gun Charge Dismissed on First Appearance in Union County

Last week, I represented a client charged with a second-degree possession of a unlawful weapon, a handgun, possession of a magazine clip, possession of marijuana under 50 grams and a slew of motor vehicle charges.  Any gun charge in New Jersey faces a mandatory jail sentence even if there are no priors.

The client hired me very soon after he was charged and we communicated almost daily on our defense.

My client could either enter Pre-Trial Intervention or plead to simple possession of marijuana under 50 grams and a dismissal of all the other charges.

I advised my client to plea to the possession charge as Pre-Trial Intervention would involve a period of probation and if my client found himself arrested at any time while on probation all these charges would be brought back.  It was not worth the risk.

With a lot of hard work and effort my client entered a plea with no prison time and paid only a minimal fine receiving no loss of license on his first appearance.
