I recently had a closing where I represented the buyer purchasing their first ever home. The buyers were a young couple that were engaged but not married. For their deposit they provided a check from both parties for the deposit.
Several weeks later I was informed by the loan company that they would not accept multiple deposit checks and requested one of the checks be refunded by the seller’s attorney.
If you have a closing with an unmarried couple as the buyers contact the loan company and ask the loan officer if there are any type of special rules to follow regarding the initial deposit or any separate paperwork. In this case, the other attorney was very cooperative and things when smoothly at closing.
